Benson Ritho filed an application yesterday accusing Waititu of demolishing his property despite court orders restraining any development the disputed land.
On February 25, Justice Pauline Nyamweya ruled that no one should interfere with the land, in any way. However, Ritho claims Waititu trespassed on the property on May 29, at wee hours of the morning and demolished structures.
The businessman claims although the former MP is aware of the court’s orders, he has “blatantly and in a clandestine manner” trespassed and destroyed structures.
Ritho wants the court to jail or fine Waititu. The dispute involves the sale and subdivision of a 50-acre plot of land in Embakasi constituency which the developer lays claim to.
Rangwe MP George Ogalo has been mentioned in the case and been accused of illegally subdividing the land. Ritho went to court last year and sued Ogalo and his surveying company, George Systems, for allegedly subdividing and transferring his properties to third parties without his consent.
He says Waititu obtained the land unlawfully. The businessman applied to have Waititu joined in the proceed- ings as an interested party....(The Star)
