Thieves Attempt To Steal Mutula Kilonzo's Coffin: Efforts Thwarted

Makueni, Kenya: Police in Mbooni have been deployed to the rural home of the departed Makueni Senator Mutula Kilonzo following an attempt by suspected thugs to break into his grave. Mbooni East OCPD James Baraza confirmed they had received information that some people had planned to steal the casket containing the remains of the late Mutula. 

The incident reportedly happened on Friday night though relatives declined to discuss the matter referring reporters to the police. The police boss said the suspects did not accomplish their mission as employees and neighbours raised the alarm forcing them to flee. 

The number of the suspected raiders could not be immediately established but the OCPD said investigations have been launched. “We received intelligence reports that there were some people planning to raid the Woyani home of the late Mutula and moved with speed to tackle the matter,” said Baraza. - The Standard.

'I had a relationship with the deceased, Hon. Mutula Kilonzo, between the year 2005 and 2008 which resulted into a minor born on May 5, 2006.'

'On May 3, 2013 my advocate wrote a letter to the deceased widow as the representative of the estate seeking an intervation through a process of mediation but the said letter has not elicited any response from the deceased's familt to date.'

'I am not in the financial position to take care of the expenses that come with maintenance and care of the minor. I am struggling to educate, clothe, feed and provide for child and pray that the estate of the deceased recognizes the minor as beneficiary of the deceased and thereby contributes towards the child's upkeep.'

DNA Samples To Be Extracted From The Late Mutula's Body - High Court Orders

NAIROBI, Kenya, May 8-The High Court has now ordered for DNA samples to be extracted from the body of the late Makueni Senator Mutula Kilonzo following an application by a woman who claims paternity for her seven-year-old son.
 
Justice Luka Kimaru has ordered that samples be taken to determine parenthood after Eunice Nthenya through the Federation of Women Lawyers (FIDA) filed the case at the Milimani Law courts.

Nthenya who identifies herself in the suit papers as the daughter of the late Kilonzo’s herdsman claims that the deceased is the father of her son Jackson Muuo who was born on May 5, 2006.

She claims that she was in a relationship with the late lawyer between 2005 and 2008.
The High Court has now ordered that the DNA samples be extracted before the late Kilonzo is buried at his Mbooni home on Thursday. 

The late senator was found dead at his Maanzoni home on April 27.
Pathologists are yet to release results of the late Kilonzo’s postmortem conducted last Tuesday.

Pathologists who conducted the postmortem at the Lee Funeral Home said that it will take them between eight to 10 weeks to make a conclusive finding.

Government Spokesman Muthui Kariuki told Capital FM News on Tuesday that President Uhuru Kenyatta who is expected back from a London trip is expected to attend the late Kilonzo’s funeral.

Chief Justice Willy Mutuga: My Tribute To Mutula Kilonzo

I first met Mutula in July 1973 when I enrolled to read for my Master of Laws degree in the Faculty of Law, University of Dar es Salaam. 

Mutula was in his third and final year of study for his Bachelor of Laws degree. I quickly found out he was one of the outstanding students in his class. Dar was a place for hard work, but this did not stop us, the Kenyan students in Dar, from posing for pretty photographs that were carried in the print media in one of the many media pieces on Mutula. We also welcomed him back in Dar after his marriage in December 1973. We were overjoyed and Mutula wore the coat of his wedding suit for the occasion!

Mutula wrote his exams in March 1974 and before leaving for Kenya, he gave me a telephone number of his relative with a request that I relay his examination results as soon as they were out. I was very proud as a Kenyan to communicate his record-breaking academic feat when Mutula became the first East African to obtain a first-class degree in law in the history of the Faculty of Law, University of East Africa, Dar es Salaam. 

Mutula co-authored a brilliant dissertation with George Masese, his classmate and now a practising Advocate in Kisii as third year student. They wrote on peasants and the co-operative movement in Kenya using a Marxist-Leninist methodology. I have always believed that at Dar, Mutula came to understand how the capitalist system works. He used his brilliant faculties to prove that Marx and Lenin were right in how that system worked! And how that system, if well understood, could enrich lawyers, too!

I saw a lot of Mutula while he was at the Kenya School of Law, but saw more of him when employed by the firm of Kakuli & Mati Advocates. I had worked for this firm before I went for further studies in Dar. 

He worked very hard and soon set up his firm. Mutula was always focused and worked hard to achieve his goals. I had occasion to do some briefs for Mutula when I was not teaching law at the Faculty of Law at the University of Nairobi. There were many closures of the university in those days. 

Mutula was kind enough to loan me Ksh10,000 to help me buy a sports Mazda car, which I paid back by undertaking legal briefs for him. At some point, we thought we could be legal partners, but I chose the path of the academy and activism. Although our political paths were distinctly different, we remained friends and deeply respected each other’s political positions.

There is one act of humanity Mutula carried out which I will never forget. Upon my release from detention on October 20, 1983, he sought me out, gave me some money and quickly facilitated the renewal of my practising certificate as an Advocate of the High Court of Kenya.

He was then the President of the Law Society of Kenya. I got my certificate and in January 1984, I was a sub-tenant of one of my close friends and former student, Joe Nzioka. I had a means of livelihood, thanks to these two friends. As a freed detainee, I was shunned by many, but Mutula did what a friend should always do, help friends in need. I am sure there were possible political consequences for his action, but that did not deter him at all.

Mutula will also be remembered for his focused stewardship as Minister of Justice and Constitutional Affairs and the promulgation of the Constitution of Kenya in 2010. He stood out as a brilliant interpreter of the Constitution and courageously guided its implementation through his legal advice. He worked tirelessly on drafting the various statutes that were the core to the implementation of the new Constitution.

Mutula gave me tremendous support when I assumed the Office of the Chief Justice. He supported the Judiciary in its assertion of independence. He attended the launch of the Judiciary Transformation Framework and supported its implementation. Mutula never missed any of our functions at the Judiciary, that in itself signalling a lot of political goodwill from the Ministry of Justice. 

He played a pivotal role in setting up the National Council for the Administration of Justice, the assembly line for the justice sector in Kenya. Both of us were clear that when it comes to national matters, there was the need for robust independence of institutions but a constructive inter-dependence between them to achieve goals in the national interest.

Mutula was honest and outspoken on issues of justice and law. I admired his courage, which gave all of us in the Judiciary extra energy to carry out our transformation.

Mutula is one of the pioneers of the African Bar in Kenya, whose brilliance, professionalism and practice will remain a beacon to aspiring lawyers.

I saw a lot of Mutula during the presidential petition. He was one of the lawyers in the CORD team. One of the observers in that petition was his classmate in Dar, the Chief Justice of Tanzania, His Lordship Mohammed Chande Othman. Their reunion was a great occasion. I also saw him at the funeral of Mrs Ruth Waki on April 18, 2013 when, in his usual candour, he criticised the Supreme Court. His death nine days later was a great shock to me.

I send my heartfelt and sincere condolences to his family, the people of Makueni who elected him to the Senate, his many friends in Kenya and abroad.

May the Almighty Allah rest his soul in eternal peace.

Salim Lone: Unforgettable Moments With Mutula Kilonzo

When I congratulated Makueni Senator Mutula Kilonzo and asked for his daughter Kethi’s email address so that I could write to her, he replied with his inimitable chuckle that I could have it since I was “an honourable man.”

He went on to say he had been inundated with requests for Kethi’s hand in marriage, but the compliments that amused him most were from women who wanted him to father a child for them.

Mutula was easily the wittiest man I knew, and he would invariably find an instant way to capture the spirit and meaning of a moment or an idea in a few simple words – an invaluable skill for a political leader. But he could also be infuriating. His vibrancy, his intellectual ferment, his astonishing courage and deeply independent thinking would routinely unsettle friend and foe alike.

But these were the qualities, which established him as a major national figure in just the eight years he lived since he achieved major national prominence in the 2005 referendum on the draft Constitution.

For most of the time I knew Mutula, he belonged to an opposing political party. But he was such a compelling person that I became as close to him as to ODM leaders I had known for decades.

However, I was definitely not a fan when I first met him in 2005, having just returned to Kenya after two decades in exile. Still feeling my way around our fluid political labyrinths, I had one particularly strong, albeit simplistic, belief – anyone connected to Kanu and former President Moi was best kept at a long distance.

But I had to swallow that anti-Kanu stricture when I joined the Orange camp as its spokesman in the campaign in that year’s referendum, given Kanu’s important role in that struggle.

Nevertheless, I complained to former Prime Minister Raila Odinga that he should not be giving important Orange campaign statements I was writing to Mutula to read, since I believed choosing a former Moi confidante as a major face of the campaign was hurting the anti-referendum drive among the core reform community.

Intellectual depth

Raila laughed. “Don’t worry.” he replied. “You will soon see how important it is that we build Mutula. He is brilliant and is going to be a major player for reform in this country.”

This turned out to be the case in the following years. Few political leaders contributed as much as Mutula did – in intellectual depth, hard and committed work, and the most astonishing courage –to push the reform agenda, the new Constitution, and to upholding the rule of law, including fidelity to international treaties.

President Uhuru Kenyatta, who as Kanu leader in 2003 first brought Mutula to national prominence by nominating him to Parliament, highlighted his commitment to principles in his condolence message.

That 2005 referendum campaign was one of the most electrifying periods in our country’s political history. It crystallised – unlike the 2002 election – the issues that we needed to build consensus on: devolution, land, marginalisation and the Executive’s power. The campaign also became the crucible for the emergence of a new Kenyan leadership.

Not only Mutula but also Uhuru and Deputy President William Ruto emerged as major national players.

Orange had created a brand new national team, which overwhelmed President Kibaki’s narrowly-constituted administration by seven provinces to one margin, catapulting Raila to the country’s political front runner.

That campaign’s final impact was to be felt eight years later, when all its four leaders would contest the 2013 presidential election – Uhuru and Ruto versus Raila and Kalonzo.

Mutula was also instrumental in that campaign helping me understand the complexities of reform in Kenya.
It was in fact that campaign, which made me realise how important it was to harness all the country’s major political currents if reform was to have wide acceptance that is indispensable to its success, because it would ensure its sustainability.

Extra-judicial killings
In that regard, my involvement in that campaign turned out to be a Godsend as it brought together virtually the entire new cast of younger leaders with whom I became friends – friendships which survived the many political realignments that took place.

My friendship with Mutula gained new impetus after the 2007 election, when President Kibaki appointed him to the Kofi Annan negotiations team. Subsequently, we spent a week together in Geneva in 2009.

I was part of the Government’s delegation to the meeting of the UN Human Rights Council debating the report on extra-judicial killings by Prof Philip Alston.

There were ministers from both sides of the coalition – including Prof George Saitoti, Amos Wako, Amason Kingi and James Orengo. Current Foreign Affairs Cabinet nominee Amina Mohamed and I were to do the drafting of the statement.

Such were the dissonances in the grand coalition then that despite the official attacks on the Alston report, the Government’s formal position still had not been determined.

This was left to the ministers in Geneva under Mutula’s guidance as Minister for Justice and Constitutional Affairs. Mutula brilliantly treaded multiple fault lines on this super-sensitive issue, and with Orengo’s help, developed a consensus to accept the Alston report while challenging aspects of the rapporteur’s mandate.
Mutula began as a pro-establishment strategist and ended up as a reformer – when in fact most politicians follow the opposite trajectory.

He will live long in our hearts for contributing immensely to Kenya’s democratic development, but there is so much more he was destined to achieve had his life not been so tragically cut short. There is no doubt he was going to be a central player in determining the shape of politics in the run-up to the 2017 elections.

Who Killed Mutula Kilonzo? - The Probe Continues as A Mysterious Person Appears

Detectives investigating the death of Makueni Senator Mutula Kilonzo are exploring the presence of a mysterious visitor at his Maanzoni home when he died last Saturday.
The visitor is said to have been questioned by detectives but police have deepened the mystery because they have maintained silence on the details emerging from the investigation into the death of the maverick politician.
Investigators believe the guest could provide critical information on the last moments of the Senator whose death has puzzled the country.
Multiple sources — who cannot be named because they are not allowed to speak on behalf of the family — say that the preliminary findings from the postmortem examination were unlikely to change significantly when the final report is prepared.
And, going by the preliminary findings, police have no reason to detain any of those who were at Mr Kilonzo’s house, unless further investigations raise a different line of investigation.
Besides the mysterious visitor, police have questioned the farm manager, a cook, a supervisor and the housekeeper and recorded their statements.
An officer privy to the investigations told the Sunday Nation that the statements by some of Mr Kilonzo’s employees are not consistent. Two of the employees have written that there was a guest at the house while others did not mention the visitor.
Another officer said the postmortem examination findings did not leave any room for conjecture in establishing the cause of death, but it had been agreed that the decision to release the report should be left to the family.
The postmortem examination was conducted by seven doctors led by chief government pathologist, Dr Johansen Oduor at the Lee Funeral Home in Nairobi.
British pathologist Calder Ian Maddison flew to Kenya at the family’s request and took part in the examination.

Further reports have showed that an unlabelled bottle containing pills was among samples taken from Mr Kilonzo’s bedroom by detectives after the death was reported.
The Senator’s body was found tucked in bed with foam in the mouth. There were also indications that the lawyer had vomited and samples were collected for analysis.
Besides the pathologists, detectives have engaged experts at the Government Chemist to examine the pills and other samples.
Fresh reports emerged Saturday that seemed to contradict earlier information that Mr Kilonzo had not been seen alive on April 27, until he was discovered dead at around 11am.
According to the new reports, the Senator had woken up early and spent about 30 minutes at the swimming pool within the compound of his palatial home.
At that time, the visitor was in the house.
Police also reviewed video footage captured by CCTV cameras mounted around Mr Kilonzo’s home.
Director of Criminal Investigations Ndegwa Muhoro said: “The doctors are holding the key to this investigation. You start with learning the cause of death from the doctors before you decide whether to pursue it further or end it. It could be different if it was a matter of an attack where injuries are visible.”
Contacted by the Sunday Nation, Inspector-General of Police David Kimaiyo said: “It’s too early to tell what happened because the investigators are looking back to several weeks before the incident. We are looking at layers and layers of investigation.”
After the postmortem examination, the pathologists said they were in agreement, adding that findings would be available after eight to 10 weeks. However, the doctors did not tell the media what they had agreed on.
On Thursday, Mrs Nduku Kilonzo, the Senator’s wife, told reporters at the family’s Gigiri home that the samples collected from her husband’s body and home would be tested locally because Kenya has the required facilities.
But when fielding questions at a press conference at Mr Kilonzo’s offices, the Senator’s son, Mr Mutula Kilonzo Junior, told reporters the samples would be tested abroad. That briefing was called to announce that Mr Kilonzo would be buried at Mbooni and not Maanzoni as earlier stated.
Another officer said the first batch of detectives who entered the bedroom after the death report was made said the scene had probably been disturbed. He added that Mr Kilonzo’s long time chef and housekeeper may help unravel the mystery on the possibility of there having been another person in the house.

“It is just part of our investigations ... we are not saying for sure that there was another person, but some things are not adding up,” said the officer who spoke on condition of anonymity.

Before pursuing the latest line of investigation, detectives had suspected other causes of death including heart attack, suicide, drug overdose, poisoning or an insect bite.

The chef, Mr John Mulei, is believed to have been close to the former minister.
“He was his confidant in some ways,” said a worker at the ranch, adding that they were under strict instructions not to speak to the press.

The Senator’s Valhala home has a state-of-the-art security system complete with CCTV cameras and the entrances are opened through lock combinations and are remote controlled.
The Sunday Nation spoke to yet another detective who said: “If there was a second person in the house, the person who opened the door in the morning to prepare breakfast must have seen something.”
Forensic expert, Dr Geoffrey Mutuma, who at one time was Mr Kilonzo’s doctor, says the issue of his bedroom not being locked raises more questions than answers.
“Indications are that there is a possibility of another person who accessed the room,” the doctor added.“The question is; was it a habit for the Senator to spend the night in his room while living the bedroom door unlocked? Looking at the surrounding of his ranch as a forensic expert I find this disturbing,” said Dr Mutuma.

Sources say that workers who have spoken to investigators have said it was not strange for the senator to have visitors during his stay at the ranch on weekends and that some would spend the night.

Mutula wa Kilonzo — My Story

When Mzee Wilson Kilonzo Musembi and Mama Rhoda Koki Kilonzo had their second baby 56 years ago and named him Mutula, little did they know that the young boy who had to repeat class one for lack of fifteen shillings in school fees, would be a successful lawyer and legal advisor to Kenya’s president.

Mutula’s turning point came one afternoon when he was twelve years old. He returned home from school to find his parents and grandmother in tears because the area chief, David Musyoka, had brought a judge to demarcate the Musembi’s family land. “Then I didn’t know the difference between a judge and a magistrate,” Mutula says. “When I asked what was happening, an uncle told me that the chief wanted the judge to mark off my parents’ land for him.”

This incident happened during the same period that his father was having a land succession problem with his stepbrother. Mutula’s grandfather, who was polygamous, had the land shared equally among his wives — a decision that Mzee Musembi’s stepbrothers never agreed with. Consequently, one of them unilaterally decided to reallocate himself a section of Mzee Musembi’s land.

“At that age, I still could not understand how someone could just disregard all the traditional and cultural norms and take our land,” Mutula says. “I made a decision there and then to study law in order to understand the reasoning that judge had used to give away our land.”

Real Events That Lead To Hon. Mutula Kilonz'o Death

According to a housekeeper who found Mutula’s body in his bedroom, the politician arrived at the farm house about 2pm and appeared okay. The late Senator retreated to his bedroom after having his favorite meal of Githeri and roast meat at 7pm. A worker who
did not wish to be named said his boss was in a jovial mood when he arrived home driving himself: “He parked the vehicle at the parking bay and walked into the house after greeting us.” Sources said the late Mutula usually showed up for his breakfast between 9.30 and 10.30 whenever he is on the farm. 

But on Saturday he did not, prompting his long-serving cook to go and wake him up. The aged cook said he knocked on his boss’ door several times without reply. He then turned on the door’s handle and went in: “He appeared deeply asleep with a lot of foam coming from his mouth,” he said adding that he immediately called for the farm manager. The manager then called Mutula’s son Mutula Kilonzo Junior and a brother in law, Chris Musau, who were the first to arrive at the scene. 

Police officers led by Machakos Deputy OCPD Wambugu and DCIO Kavete Kuloba visited the homestead after being informed by the late minister’s family. He was the only one in the main house, as the rest of the family was said to be in his Muthaiga home, in Nairobi According to the police, the deceased had vomited on his bathroom sink, a pointer to the fact that he woke up at some point to vomit and went back to sleep. A leading Nairobi based medical practitioner who did not want to be named explained that The cause of death is difficult to determine without a physical examination. “Right now the best way to find out the cause is to wait for postmortem examination. There are many things which need to be evaluated before commenting on the cause”. said the doctor “But I can say that the house help’s narration that the Hon Senator was Frothing in the mouth happens mostly in poisoning and drug over dosages because of the piled up secretions in the airway and aspiration. The prior vomiting could have led to dehydration” the doctor added.

“A Post Mortem report will be able to confirm the cause of his death” the doctor concluded. Pathologists led by Chief Government pathologist, Dr Johansen Oduor performed preliminary examination on the body before removing and taking it to Nairobi’s Lee Funeral Home.

Rest In Peace Hon. Mutula Kilonzo. It is only God who knows why u had to depart at such speed, without any notice. Kenyans loved You but God loved you most. Go in peace till we meet again.

Kenyans Have Continued To React to Mutula Kilonzo's Death


H.E Uhuru Kenya, President of Kenya: My heartfelt condolences go out to the family, relatives, friends and residents of Makueni County following the death of Senator Mutula Kilonzo. I am shocked and greatly saddened by the untimely death of Senator Kilonzo. He was one of Kenya’s most brilliant minds, a principled politician and a renowned lawyer.He was an astute politician and leader who was immensely popular among the people of Makueni county and beyond. He was also an outstanding performer who served the country diligently in various capacities including as minister for Justice and Constitutional Affairs, Minister forNairobi Metropolitan and Minister for Education. Both as a politician and as a minister, the late Senator Kilonzo was a competent, consummate and resolute administrator who stuck to his convictions even in the face of opposition. I pray that God grants his family the strength and fortitude to bear the tragic loss. Rest in peace Senator Kilonzo. You will be greatly missed.

I had the pleasure of working with you during the time I hosted "Crossfire" on Kiss 100 alongside Otieno Kajwang', Tony Gachoka, Koigi Wa Wamwere, Mukhisa Kituyi and Ababu Namwamba. You impressed me with your bravado and honesty.. We are poorer as a nation without you... But we musn't be selfish.. Your children and wife have lost a father, husband, mentor and guide... they are in our thoughts and prayers... You fought the good fight, led a good life and you leave great examples that hard work DOES pay!!! Fare thee well and Rest in Peace, Mutula Kilonzo...

Attorney General Githu Muigai said he learnt with great shock the passing on of Mutula. Mr Githu said Mutula was a brilliant lawyer, who dedicated great part of his distinguished career to the service of the law and the legal profession.

About The Late Hon Mutula Kilonzo - Quick Facts

Born in July, 1948.

1969: Graduated with a First Class honours degree in Law from University of Dar-es-Salaam. Being the first in East Africa to have a First Class in Law.

1975: Established Kilonzo and Company Advocates. Earned his first million within eight months of practise.

He became Former President Moi's legal adviser after being introduced by Hosea Kiplagat, Moi's nephew.

For a long time he believed that Kenyan politics had very little room for independent-minded people. Declined KANU's offer for a political seat in 1992 and 1997. He later accepted the party's nomination to parliament in January 2003 and became KANU Shadow Justice Minister.

He had also served as a minister for Nairobi Metropolitan Development until being appointed in the docket of Justice and Constitutional affairs on May 4, 2009 and later on minister for Education.

Mutula Kilonzo was married and had seven Children.
Three of the children, including Mutula Kilonzo Jnr. and Kethi Kilonzo, have been his practising associates.

Breaking News Kenya - Hon Mutula Kilonzo Is Dead

Makueni Senator; Hon. Mutula Kilonzo is dead. He is reported to have slept and failed to wake up at his farm boardering Maanzoni Lodge on Mombasa-Nairobi Road.
  
Born in July, 1948.

Mutula Kilonzo while addressing parliament about his death threats sometimes back had said that; 'I have been threatened severally but l never bothered your office. But after receiving two messages 30 minutes apart from two different numbers apart saying that "Be ready to die" as though they are God. I thought that this is something I should share with my country and Hon. Colleagues so that should anything happen to me, you will know that l told you so. If they are threatening me because of my work , they are in for a rude shock because l have no intention whatsoever to change my way of life- The way I speak, the way is the way put positions clearly because I do so out of my understanding as the only senior counsel in the parliament, out of a very careful teaching and education as a lawyer'.

H.E President Uhuru Kenyatta:  My heartfelt condolences go out to the family, relatives, friends and residents of Makueni County following the death of Senator Mutula Kilonzo. I am shocked and greatly saddened by the untimely death of Senator Kilonzo. He was one of Kenya’s most brilliant minds, a principled politician and a renowned lawyer.He was an astute politician and leader who was immensely popular among the people of Makueni county and beyond. He was also an outstanding performer who served the country diligently in various capacities including as minister for Justice and Constitutional Affairs, Minister forNairobi Metropolitan and Minister for Education. Both as a politician and as a minister, the late Senator Kilonzo was a competent, consummate and resolute administrator who stuck to his convictions even in the face of opposition. I pray that God grants his family the strength and fortitude to bear the tragic loss. Rest in peace Senator Kilonzo. You will be greatly missed.
 
Kethi Kilonzo (Mutula's daughter):  'i really dont understand,i dont know.im just a human being devoid of wisdom and knowledge.we will trust in the Lord ,the father to the orphans and husband to the widows'.
